Terms of use and sale

These terms govern the use of the Estamp app and of the merchant plan. They are offered by Antoine RICOURT, sole proprietor (micro-entreprise), SIREN 893 043 836, registered at 18 rue de Boyer, 69160 Tassin-la-Demi-Lune, France ("Estamp", "we"). Contact: contact@estampapp.com.

1. The service

Estamp replaces the paper loyalty card of local shops. For customers the app is free: you join a shop's card by scanning the QR code at the counter, then ask for stamps with each purchase. For merchants, a paid subscription lets them run a card, approve requests and see their history.

A stamp is never added automatically: every request is approved, corrected or declined by the merchant. A request left unanswered expires at the end of the day.

2. Account

You must be at least 15 years old to create an account. You agree to give accurate information and to keep your sign-in details private. An account is personal.

You can delete your account at any time from your profile. Deletion immediately and permanently erases your cards, history, rewards and, if you have one, your shop and its data.

3. Stamps and rewards

Stamps and rewards are granted by each merchant, under their sole responsibility. Estamp provides the tool, not the perks: a disagreement over a stamp or a reward is settled with the shop concerned.

Stamps have no cash value, cannot be exchanged or refunded, and do not transfer between shops or accounts. They do not expire over time. If a shop stops using Estamp or deletes its card, the stamps collected there can no longer be used.

Asking for stamps without a matching purchase, sharing or copying a shop's QR code to obtain them, or working around how the service operates is forbidden. We may suspend an account that does so.

4. Privacy towards merchants

By default a merchant only sees a six-character public ID for you. From your profile you can choose to show them your first name and last initial — never your full name or email address. Details are in the privacy policy.

5. Merchant plan

The merchant plan is for professionals acting for the purposes of their business. It includes a 30-day free trial, with no payment method, starting when the shop is created in the app.

When the trial ends, the service continues with a monthly subscription at the price shown in the app at the time of purchase (€12.99 per month, taxes included, as of these terms). The subscription is bought and billed through the App Store (Apple) or Google Play, depending on your device, under their terms. It renews automatically every month until cancelled.

You can cancel at any time in your App Store or Google Play subscription settings, at least 24 hours before the renewal date. The current month remains due and the service stays available until it ends; no pro-rata refund is owed unless the platform decides otherwise. Deleting your Estamp account does not cancel the subscription.

Without an active subscription or trial, the merchant keeps read access to their clients and history, but can no longer approve stamps or hand over rewards, and their clients can no longer request any.

The merchant alone is responsible for the rewards they offer and hand over, for the accuracy of their card's details (name, category, photo) and for complying with the rules that apply to their loyalty programme. They agree not to use their clients' information for anything other than running the card.

We may change the subscription price. Any increase is announced in advance by the payment platform, which asks for your agreement where the law requires it.

6. Availability and liability

We do our best to keep the service available and reliable, without being able to guarantee it will never be interrupted or wrong. We are not liable for indirect damage, nor for rewards granted or refused by a merchant. Towards a merchant, our liability is limited to the subscription fees paid in the previous twelve months.

7. Intellectual property

The app, its brand and its content belong to Estamp. The merchant keeps ownership of their shop's name and photo and allows us to show them to their clients in the app for as long as they use the service.

8. Changes to these terms

We may update these terms. After a significant change, the app asks you to accept them again before you keep using it.

9. Governing law

These terms are governed by French law. In case of a dispute, please contact us first at contact@estampapp.com to look for an amicable solution. A consumer may use a consumer mediator free of charge and may bring a claim before the courts of their place of residence. Between professionals, the courts of Estamp's registered office have jurisdiction.
